CrPC and BNSS: Which Law Applies?
For criminal procedure generally, the BNSS is the current central procedural law from 1 July 2024. The CrPC is repealed, but the repeal-and-savings provision preserves the CrPC for specified proceedings that were already pending immediately before BNSS commencement. Users should therefore identify when the relevant investigation, inquiry, trial, application or appeal began before choosing a form.
The BNSS has its own Second Schedule of forms under section 522. Those current forms are not the same as this legacy CrPC index and should be checked separately for proceedings governed by the BNSS.
