Current law
Death registration in India is governed principally by the Registration of Births and Deaths Act, 1969, as amended by the Registration of Births and Deaths (Amendment) Act, 2023, which came into force on 1 October 2023, along with applicable State/UT rules.
Certificate after registration
Under section 12, after registration is completed, the Registrar must provide the prescribed registration certificate free of charge, electronically or otherwise, to the informant, as soon as possible and not later than seven days.
Obtaining a death certificate
Section 17 permits a person, subject to applicable rules and fees, to search the register and obtain a death certificate electronically or otherwise. A death certificate issued under this provision does not disclose the registered particulars regarding the cause of death.
Medical cause of death
Where applicable under section 10, medical institutions and attending medical practitioners have duties relating to certification of the cause of death. The medical cause-of-death certificate is distinct from the civil death registration certificate.
Delayed death registration
Section 13 applies when a death is not reported within the prescribed period. A delayed report within 30 days may be registered on payment of the prescribed late fee. After 30 days but within one year, written permission of the District Registrar or other prescribed authority, prescribed fee and prescribed self-attested document are required. After one year, registration requires an order of the District Magistrate, Sub-Divisional Magistrate or an Executive Magistrate authorised by the District Magistrate, after verification and payment of the prescribed fee.
