Current FIR law: Section 173 BNSS, 2023

The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) came into force on 1 July 2024. For cases governed by the BNSS, Section 173 deals with information relating to cognizable offences.

For non-cognizable cases, Section 174 BNSS provides the applicable procedure. The legal route therefore depends on whether the alleged offence is cognizable or non-cognizable.

Investigation progress: 90-day communication under BNSS

Section 193 BNSS, which deals with the police report on completion of investigation, also requires the police officer to inform the informant or victim of the progress of the investigation within 90 days, by any means including electronic communication. The provision further requires communication of the action taken to the person who first gave the information, in the manner prescribed by the State Government.

Practical point: Online FIR viewing, petition tracking and the statutory obligation to communicate investigation progress are different mechanisms. Availability of information on an online portal does not replace the duties imposed by the BNSS.
