Section 43 of Land Acquisition Act 1894 "Sections 39 to 42 not to apply where Government bound by agreement to provide land for Companies"

The provisions of sections 39 to 42, both inclusive, shall not apply and the corresponding section of the Land Acquisition Act, 1870, (10 of 1870), never to have applied, to the acquisition of land for any Railway or other Company, for the purposes of which, under any agreement with such Company, the Secretary of State for India in Council, the Secretary of State, the Central Government or any State Government is or was bound to provide land

 

Section 44 of Land Acquisition Act 1894 "How agreement with Railway Company may be proved"

In the case of the acquisition of land for the purposes of a Railway Company, the existence of such an agreement as is mentioned in section 43 may be proved by the production of a printed copy thereof purporting to be printed by order of Government.
