What is Bar of jurisdiction, Cognizance of offences and Delegation under section 79, 80 and 81 of The Real Estate (Regulation and Development Act, 2016). Bar of jurisdiction, Cognizance of offences and Delegation are defined under Section 79, 80 and 81 of the Act. Provisions under Section 79, 80 and 81 are:

 

 

Section 79 "Bar of Jurisdiction" - The Real Estate (Regulation and Development Act, 2016)

No civil court shall have jurisdiction to entertain any suit or proceeding in respect of any matter which the Authority or the adjudicating officer or the Appellate Tribunal is empowered by or under this Act to determine and no injunction shall be granted by any court or other authority in respect of any action taken or to be taken in pursuance of any powerconferred by or under this Act.

 

Section 80 "Cognizance of Offences" - The Real Estate (Regulation and Development Act, 2016)

(1) No court shall take cognizance of any offence punishable under this Act or the rules or regulations made thereunder save on a complaint in writing made by the Authority or by any officer of the Authority duly authorised by it for this purpose.

(2) No court inferior to that of a Metropolitan Magistrate or a Judicial Magistrate of the first class shall try any offence punishable under this Act.

 

Section 81 "Delegation" - The Real Estate (Regulation and Development Act, 2016)

The Authority may, by general or special order in writing, delegate to any member, officer of the Authority or any other person subject to such conditions, if any, as may be specified in the order, such of its powers and functions under this Act (except the power to make regulations under section 85, as it may deem necessary.
