Section 18 of the Central Universities Act, 2009 - Other Officers
Section 18 deals with the appointment, powers and duties of officers of a Central University who are not otherwise specifically dealt with in the preceding provisions. The section leaves the detailed rules to the Statutes governing the University.
The manner of appointment and powers and duties of other officers of the University shall be prescribed by the Statutes.
Meaning and scope of Section 18
Section 18 is an enabling provision. Instead of fixing one uniform appointment procedure and one set of functions for every additional University officer in the Act itself, Parliament has provided that these matters are to be regulated through the applicable Statutes of the University.
Accordingly, where a post falls within the category of an "other officer" of the University, the relevant Statutes should be examined to determine the method of appointment and the powers and duties attached to that office. Section 18 therefore has to be read together with the statutory framework applicable to the particular Central University.
What does "prescribed by the Statutes" mean?
For Section 18, the important legal point is that the details are not left merely to informal administrative practice. The Act expressly refers to the "Statutes". The governing Statutes are therefore the primary place to verify the prescribed appointment mechanism, authority, functions and responsibilities of an officer covered by this section.
Key points under Section 18

- The manner of appointment must be determined in accordance with the applicable Statutes.
- The powers and duties of such officers are also governed by the Statutes.
- For any particular office, the current Statutes and valid amendments applicable to that University should be checked along with the Act.
