Section 25 of the Central Universities Act, 2009 - Other Authorities of University

Section 25 deals with University authorities other than the authorities specifically described in the preceding provisions of the Central Universities Act, 2009. It provides the statutory mechanism by which additional authorities may be constituted and governed through the Statutes of the University.

Text of Section 25 - Other authorities of University

The constitution, powers and functions of other authorities, as may be declared by the Statutes to be the authorities of the University, shall be prescribed by the Statutes.

Meaning and scope of Section 25

Section 25 should be read with Section 19. Section 19 identifies the principal authorities of a University and also permits the Statutes to declare additional bodies as authorities of the University. Section 25 then requires the constitution, powers and functions of those additional authorities to be prescribed by the Statutes.

In practical terms, the provision does not itself create or name every possible additional University authority. Instead, it enables the statutory framework of a particular Central University to provide for additional authorities when required and to define their composition, powers and functions.

What does "prescribed by the Statutes" mean?

For Section 25, the relevant rules concerning an additional authority must be found in the Statutes made under the Central Universities Act, 2009. The Act separately provides, in Section 26, for matters that may be dealt with by Statutes, including the constitution, powers and functions of University authorities and other bodies.

Relationship with Sections 19 and 26

Section 19 establishes the basic list of University authorities and recognizes additional authorities declared by the Statutes. Section 25 governs the constitution, powers and functions of those additional authorities. Section 26 supplies the broader statutory power for making provisions in the Statutes concerning University authorities and bodies.

Why Section 25 is important

The provision allows the governance structure of a Central University to accommodate additional statutory authorities without requiring the Act itself to list every body that may become necessary. At the same time, the authority must derive its status and governing framework from the Statutes rather than from an informal administrative arrangement.
