Current Law on Birth Certificates
Registration of Births and Deaths Act, 1969: Birth registration and certificates are governed by the central Act as amended by the Registration of Births and Deaths (Amendment) Act, 2023, which came into force on 1 October 2023.
Electronic certificates: Section 17 now provides for obtaining a birth or death certificate electronically or otherwise, subject to the applicable State rules, prescribed form and fees.
Persons born on or after 1 October 2023: The amended law provides that the birth certificate under Section 12 or Section 17 is to be used to prove the date and place of birth for specified purposes such as educational admission, driving licence, voter list, marriage registration, certain public appointments, passport and Aadhaar.
Delayed Birth Registration and Corrections
A request for a certificate from an already registered record is different from registering a birth that was never registered. Delayed registration is governed by Section 13 of the Registration of Births and Deaths Act, 1969 and the applicable rules. Correction or cancellation of an entry is dealt with under Section 15.
