Current Legal Position
The earlier IPC provision commonly cited for violation of a lawful tenant-verification order was Section 188 IPC. The corresponding current provision is Section 223 of the Bharatiya Nyaya Sanhita, 2023. Section 223 concerns knowing disobedience of an order duly promulgated by a lawfully empowered public servant and provides different punishment levels depending on the consequences or risk caused by the disobedience.
Accordingly, tenant verification should not be described as universally compulsory merely because Section 223 BNS exists. A prosecution or penalty under that section requires a valid order, knowledge of the order, disobedience and the statutory conditions. Landlords should nevertheless comply with any applicable district, local police, executive-magistrate, housing-society or other lawful verification direction in force for their area.
