Tenant Information: What the Official Portal Says
Thane Rural Police provides an online facility for people renting out a flat, house or other eligible premises within its jurisdiction to submit tenant information.
Important: The official Thane Rural Police page states that a police NOC is not required for renting a flat or house. Tenant information can be provided online, submitted directly to the concerned police station, or sent to that police station by registered post.
The online service also states that an OTP is sent to the property owner's contact number. The owner and tenant should ensure that the information supplied is true and complete.
Current Legal Position: BNS Section 223
The earlier version of this guide referred to Section 188 of the Indian Penal Code, 1860. India's new substantive criminal law, the Bharatiya Nyaya Sanhita, 2023, came into force on 1 July 2024.
Section 223, Bharatiya Nyaya Sanhita, 2023 deals with disobedience to an order duly promulgated by a public servant. Depending on the consequences of the disobedience, the provision prescribes imprisonment, fine, or both.
This does not mean that every tenancy automatically requires a police NOC. The Thane Rural Police tenant-information page expressly states that a police NOC is not required for renting a flat or house. Any legal consequence for non-compliance depends on the existence and applicability of a lawful order and the facts of the particular case.
