Current Law Governing Death Certificates

Registration of deaths is governed by the Registration of Births and Deaths Act, 1969. The law was amended by the Registration of Births and Deaths (Amendment) Act, 2023, with the amendments taking effect on 1 October 2023.

Section 17 now expressly permits a person, subject to the applicable State rules and fees, to search the register and obtain a birth or death certificate electronically or otherwise. A death certificate issued under that provision must not disclose the cause-of-death particulars recorded in the register.

Delayed death registration: Under amended Section 13, a death reported after 30 days but within one year requires the prescribed written permission, fee and self-attested document. A death reported after one year can be registered only on an order of the District Magistrate, Sub-Divisional Magistrate, or an Executive Magistrate authorised by the District Magistrate, after verification and payment of the prescribed fee.

Section 15 of the Registration of Births and Deaths Act provides the statutory framework for correction or cancellation of entries that are erroneous in form or substance, or that were fraudulently or improperly made, subject to the applicable rules and the Registrar's satisfaction.
