A birth in Maharashtra must be registered with the local Registrar having jurisdiction over the place where the birth occurred. Depending on the location, this may be the concerned Gram Panchayat, municipal council, municipal corporation or another designated registration authority. For notified rural services, Maharashtra's Aaple Sarkar portal lists the Birth Certificate service under the Rural Development and Panchayat Raj Department.
Current law governing birth certificates in Maharashtra
Birth registration is governed principally by the Registration of Births and Deaths Act, 1969. The Act was substantially amended by the Registration of Births and Deaths (Amendment) Act, 2023, and the amended provisions came into force on 1 October 2023.
Section 12 of the amended Act requires the Registrar, after completing registration, to provide the registration certificate electronically or otherwise, free of charge to the informant, within the statutory framework prescribed by the Act and rules.
How to register a birth in Maharashtra
The normal period prescribed for reporting a birth is 21 days from the date of occurrence. Where a birth takes place in a hospital or other institution, the institution normally reports the event to the concerned Registrar. For a birth occurring at home, the person responsible under the Act must report the event to the local Registrar.
- Identify the registration authority having jurisdiction over the place of birth, not merely the family's current residence.
- For an institutional birth, confirm that the hospital or institution has reported the event.
- Provide the particulars and documents required by the concerned Registrar or online portal.
- Check all spellings, names, date, place of birth and parents' particulars before final submission.
- After registration is completed, obtain the birth certificate or electronic certificate from the authorized system or registration office.
Registration within 21 days
When the birth is reported within the normal 21-day reporting period, registration is ordinarily made without a delayed-registration fee, subject to the applicable rules and verification.
Delayed birth registration after 21 days
Section 13 of the Registration of Births and Deaths Act, 1969, as amended with effect from 1 October 2023, provides the legal framework for delayed registration.
| Delay | Current legal position |
|---|---|
| After normal period but within 30 days | Registration may be made on payment of the prescribed late fee. |
| After 30 days but within 1 year | Written permission of the District Registrar or other prescribed authority is required, together with the prescribed fee and self-attested document(s) in the prescribed form and manner. |
| After 1 year | An order of the District Magistrate, Sub-Divisional Magistrate, or an Executive Magistrate authorised by the District Magistrate having jurisdiction over the place of occurrence is required, after verification and payment of the prescribed fee. |
For an old or unregistered birth, do not submit a routine certificate-download request as a substitute for registration. First follow the delayed-registration process applicable to the age of the event and the local authority having jurisdiction.
Apply for Maharashtra Birth Certificate through Aaple Sarkar
Aaple Sarkar currently lists Birth Certificate as an online service under the Rural Development and Panchayat Raj Department. This route is particularly relevant to notified Gram Panchayat/rural services. Municipal and corporation areas may use their own authorized local-body systems or the applicable Civil Registration System workflow.
- Visit the official Aaple Sarkar portal.
- If you do not have an account, select the registration option and create a user profile using the available OTP/profile process.
- Log in with your registered credentials.
- Open the Rural Development and Panchayat Raj Department services.
- Select Birth Certificate.
- Complete the application and provide the Application ID, registration details or supporting information requested by the portal.
- Upload documents, if requested, and complete any applicable payment step.
- Submit the application and save the generated acknowledgement/Application ID.
Track birth certificate status and download
- Open Aaple Sarkar if your application was filed there.
- Select the Track Your Application facility.
- Enter the Application ID or other details requested.
- Check whether the application is pending, approved, rejected or requires further action.
- When the certificate is digitally issued and the portal provides a download option, save the certificate PDF for your records.
If the birth was registered through a municipal corporation, municipal council, hospital-linked system or another authorized civil-registration portal, obtain the certificate through that authority's official channel rather than assuming that every Maharashtra birth certificate will appear in Aaple Sarkar.
Aaple Sarkar service time limit for rural Birth Certificate
The current Aaple Sarkar notified-services list shows the following service-delivery structure for Birth Certificate under the Rural Development Department:
| Item | Authority / Time |
|---|---|
| Notified service time | 5 working days |
| Designated Officer | Gram Sevak |
| First Appellate Authority | Assistant Block Development Officer |
| Second Appellate Authority | Block Development Officer |
The Maharashtra Right to Public Services Act, 2015 provides a time-bound framework for notified public services and a right of appeal where a notified service is delayed or wrongfully rejected.
Birth certificate as proof after the 2023 amendment
For a person born on or after 1 October 2023, the amended central law provides for the birth certificate to serve as proof of date and place of birth for specified purposes, including:
- admission to an educational institution;
- issuance of a driving licence;
- preparation of a voter list;
- registration of marriage;
- appointment to specified Central/State Government, local body, PSU, statutory or autonomous body posts;
- issuance of a passport;
- issuance of an Aadhaar number; and
- other purposes that may be determined by the Central Government.
Correction, name inclusion and old records
Correction of an entry, cancellation of an entry, inclusion of a child's name, and obtaining an extract from an old register are separate legal/administrative processes. Applicants should use the specific procedure prescribed by the concerned Registrar and should not file a fresh birth event merely to correct an existing record.
